Privacy Policy
Privacy protection is a concern for everyone. Rigaud Legal Inc. (“Rigaud Legal” or “we”) is committed to safeguarding the confidentiality of information concerning its clients. This policy applies to the personal information of our clients and third parties (“you”). This Privacy Policy (the “Policy”) describes the type of information we collect, how we use it, and the security measures we have implemented to protect that information and your privacy, as well as the rights available to you.
We cannot accept any confidential information until we have confirmed in writing that we represent you, your company, or your organization, or that we are acting on your behalf or on behalf of your company or organization. Unsolicited emails we receive from individuals who are not clients do not create a lawyer–client relationship. Such emails may not be protected by solicitor–client privilege and could be disclosed to third parties. If you provide us with personal information about other individuals, you must ensure that you have obtained their prior consent and have informed them that you are sharing their information with us.
To comply with anti–money laundering laws, we may collect identification data and other background verification information, such as copies of official documents issued by government authorities or even a utility bill, as well as evidence of beneficial ownership or information regarding the source of funds.
We collect through our website only the information you voluntarily provide when you choose to contact us in that manner. By providing us with personal information (through our website, by email, in person, by telephone, or otherwise), you agree that such information will be processed in accordance with this Policy and you authorize Rigaud Legal, the third parties with whom we act, and our service providers to process your personal information in accordance with this Policy.
If, however, you do not consent to the collection, use, and disclosure of your personal information in accordance with this Policy, please do not send us your personal information and do not use the website www.rlegal.ca (the “Website”). If you choose not to provide certain required personal information, we may be unable to offer certain services or represent you. You may modify or withdraw your consent at any time upon reasonable notice, subject to any legal or contractual restrictions.
Collection, Use, and Disclosure of Personal Information
“Personal information” means any information about an identifiable individual or information that allows an individual to be identified. Generally, this term does not include your name, business address, or business contact details—such as your title, business email address, or business telephone numbers—that you provide to us for professional purposes.
We usually collect personal information that you voluntarily provide to us, but we may also collect information from third parties or act as agents for our clients if we or they have obtained the required consent or if permitted or required by law. We may also collect information through our Website, although such information is typically limited to your name and email address.
We will obtain your consent before collecting, using, or disclosing personal information for any purpose, unless otherwise permitted or required by law. Consent may be given verbally or in writing; it may also be implied, for example, when you continue to provide personal information as part of our ongoing relationship or when you provide your personal contact details to Rigaud Legal personnel in connection with a mandate.
This may include personal information you provide when we represent you in a dispute, which we may subsequently be required to disclose in connection with that proceeding. By providing personal information to us, you consent to the collection, use, and disclosure of that information in accordance with this Privacy Policy and as permitted or required by law.
We collect, use, and disclose personal information primarily for the purpose of providing services—such as legal advice and representation—to current and prospective clients; for administrative and client relationship management purposes (including marketing and the delivery of Rigaud Legal’s services); or for other purposes authorized or required by law.
We may occasionally engage third-party service providers to perform certain functions on our behalf, such as office support or data processing. In such cases, these third parties will be required to protect the personal information transferred to them using safeguards comparable to those we employ and described in this Policy, and they may not retain, use, or disclose personal information for any purpose other than providing services to Rigaud Legal.
We retain personal information only as long as necessary for the purposes for which it was collected or to comply with legal or professional requirements. We may disclose your personal information and other data if we are legally required to do so, for example, in response to a court order, subpoena, search warrant, or similar legal demand.
We may also share your information with government authorities and law enforcement agencies where necessary to comply with applicable laws or to cooperate in an investigation. Likewise, we may share your information in the context of a merger, acquisition, debt financing, sale of assets, or similar transaction, as well as in insolvency, bankruptcy, or receivership proceedings, to a purchaser, successor, or assignee as part of a business asset transfer.
We do not sell any personal information.
Security
We treat your personal information as confidential and ensure that it is always protected and securely stored, regardless of format. Most means of communication are not completely secure, and security measures may affect the efficient exchange of information. Email is often our preferred method of communication, and unless you object, we generally use unencrypted plain-text emails when corresponding with you.
Your Rights Regarding Your Personal Information
When you provide personal information to Rigaud Legal, through the Website or otherwise, you consent to the collection, use, and disclosure of such information in accordance with this Policy. You have the right to access, review, modify, or correct the personal information we have collected about you. You may also withdraw your consent to the collection, use, and disclosure of your personal information at any time.
Your right of access is not absolute. If your request for access is refused, we will provide the reasons for our refusal.
